Meet Phillip Bleicher, the man behind Flava Works. He's the white guy in the middle of the picture hiding from television cameras outside a Miami Code Enforcement Board meeting last month. But why is he hiding?

This is the guy who says his company has done nothing wrong. This is the guy who says his black "models" practice safe sex in the porno dorm flicks he broadcasts on the Internet. This is the guy who says he's not exploiting young black gay men. This is the guy whose company recently made a porno flick called "The House Next Door" to profit from the controversy surrounding Flava Works. And this is the guy who hired a just-passed-the-bar Miami attorney to threaten two prominent black LGBT bloggers with a lawsuit recently because they were somehow libeling his company. So why is this man hiding if he is so proud of his work and his company? Or does he have something to hide?

Back in June, I learned that Flava Works was threatening to sue a black LGBT blogger and colleague because he posted an article about the controversy on his web site. Then a few weeks later I learned that Flava Works was also threatening to sue another black LGBT blogger and colleague because of an article she had written on her site as well. Flava Works gave her until July 18 (today) to respond or face a lawsuit. That's not a good move for Flava Works. Jasmyne Cannick, the female blogger who was threatened, will be responding on her blog later today.

I don't know if the young lawyer they hired knows the law, but the threat won't work. I did notice that the lawyer in the recent TV video (shown here) is different from the lawyer who sent the threatening letters to the two bloggers. I also remember a little something about libel from my days in law school.

Truth is an absolute defense to claims of libel. From what I can tell, nothing that the bloggers have written is untruthful. It may be unflattering to Flava Works and its (already sullied) reputation, but that does not make it untruthful. All that the bloggers have done is simply to report the facts that were already reported in other media outlets and by official government agencies. That's what journalists do everyday. If Phillip Bleicher doesn't like it, that doesn't make it libelous. He and his attorney should go back and read the law.

It's also true that libel has to be harmful in order to hold up in court, but the people at Flava Works don't appear to be harmed by the bloggers' criticism. In fact, they seem to revel in it. Their latest video, The House Next Door, plays on the recent controversy about their Miami house: "You read about it, you even saw it on the nightly news," the advertisement says. "[B]ut now go inside to and see what they could not show you on TV - non-stop f---ing with the hottest black and latin boys around!"

The good news is that the video creators now say that "condoms are used in every scene." That's a victory for the critics. The bad news is that Bleicher still seems intent on silencing the very critics who encouraged the condom policy in the first place.

Sadly, these most recent developments come just days after the reported death of Dekenric Wiley, the Vice-President of Flava Works. The 32-year-old Wiley, also known as Devin, passed away July 14 from pneumonia, according to Flava Works.

The death of Dekenric Wiley underscores the tragic loss of life that has taken place in the black gay community in the past 25 years. That's all the more reason why it is essential for people of conscience to speak up.

This is not an attack on porn. This is a call for responsibility and accountability by people who run the industry in our community.

While young black men are dying every day, it is an outrage that one white guy in Florida is trying to silence the voices of black men and women who are ringing the alarm about an important health and safety issue facing our community. It's time for that to end. It's time for Phillip Bleicher to stop trying to sue black LGBT bloggers and start trying to understand their concerns.

Keith, you know that I love you, but this post is disappointing. Devin has not been dead for a week---this could not have waited? The friends and family of Devin Wiley (especially his mother) are in a time of deep mourning & this is not the time for them to have to deal with a backlash against the company he worked for. These debates could have waited. I am not convinced that another discussion over the race of Flavawork's CEO needed to take place right NOW, less than five days after Devin died. There was no new information that emerged that made it necessary for us to bring this back up again. Regardless of our personal opinions, the fact remains that Devin Wiley did in fact enjoy & willfully chose to work for Flavaworks.

Devin Wiley died on Saturday. His life & death should not be overshadowed by discussions over the race of the man he worked with. Whats next, are we going to crash Devin's memorial service with picket signs? I understand the impulse here, however the timing is woefully inappropriate.

I'm not really surprised that a white dude is behind it. Most black companies have some white influence behind them. Record companies (Stax), big broadway productions (Dreamgirls) and all that stuff have huge white backing, though we are often led to believe otherwise. I'm sad to hear of the death of that young man. I don't know the models by name, but I'm sure he is just one of many over the years who have met that fate. I wish his family peace.

There is no disrespect to Wiley here. The fact that he died of pneumonia in 2007 tells me that he didn't receive adequate medical care--something that most people expect from their employers. Whether it was bacterial pneumonia or the kind that people with HIV get (which is not like the one people with healthy immune systems get), there are ways to treat it. Above that, there are ways to prevent it with inexpensive medication.

Wiley's family and friends should be glad that someone called attention to his untimely death. They should also be glad that attention has been called to the exploitative nature of his former employer.

Furthermore, based on what is known about FlavaWorks, this is slavery in the 21st century. If these young men are going to put their health on the line for a living, it ought to be worth it! However, I guess we can't blame him altogether. What happened to these young men that deprived them of better opportunities? What happened in our community that left them with this option

Let's be very clear,"Any," about this criticism about Phillip Bleicher. It is not simply because he is a white person who owns a porn company primarily featuring Black models. As you point out, the majority of porn companies are owned by white individuals. For the record, most consumers of Black gay porn already know this fact and are unconcerned about it; they just want their get-off and fantasy.

What makes Phillip Bleicher's situation as a white man unique in the industry is that he and he alone allegedly has run Flavaworks like a sharecropper from the days of Reconstruction. There are simply too many accounts (mostly from former Coco-whatever models themselves) of Bleicher's practices, from near indentured servitutde to intimidation of critics through phony lawsuits. If one is to believe the allegations, Bleicher literally acts like he owns not just his models, but the Black gay community at large. That's not "hating" on Bleicher it's because he's white, but rather because he's a modern Willie Lynch.

I am so sorry to hear about Mr. Devin Wiley's death. I understand some of the hurt that this particular article may bring to certain individuals. On the other hand, I think the purpose of the article is very usefull. Fact is that much of the news concerning black people, especially black gay people does not make it to the airways. Whether the industry is ran by black or white people is really beside the point. It is the performers in the porn that I am concerned about. They're young and I pray that they wake up. Mr. Bliecher is not exploiting anything or anyone. The compliants that the performers had came after they were released and cashed their checks. He has a good thing going and wants to protect it in order to line his pockets. He is no different than other men in business in America. A much more virulent, non-black owned porn website than features black men and that celebrates the nastiest unsafe bareback sex as well as perpetuating stereotypes (like they all do) is machofucker.com.

If we are going to be critical of unsafe gay sex practices and bad depictions of black men in porn than we need to be critical of all bareback sites and all of the industry that makes money off of the depiction of black men as criminals ("thugs") and other surly guises.

But it is impossible to be critical of everything.

It amazes me that people are attacking you for the NEWS that you are presenting. I had the opportunity of meeting and knowing Dekenric Wiley, when he lived in Chicago and e-mailed him occasionally about details about his business. I was shocked and surprised of his death.

You are 100% correct when you exposed the true players behind the scenes and how much they make at the expense of the participants (Black, White, Asian, Latin, male and female). Its all about accountability. I know people are hurt because of Dekenric Wiley's death but the reality is that part of his legacy is to realistically look at the path he traveled and learn from all aspects -- Good and Bad. Maybe someone reading this article is a young man considering doing porn for a few bucks who doesn't realize that he is just going to be exploited and that his life will be endangered. Now it's gotten to the point that he is just like Fox News - broadcasting anything sensational to make an obscure, slanted, biased and often untruthful point.

I am not into his porn, or any porn as its too low class for my tastes, but, he and the ummm, "models" need to be utilizing safe sex practices, since it may be a "choice" not to, but, I doubt if the owner is providing health insurance for the treatment of any thing they may get or spread It would be fine and dandy if they were getting their freak on only with each other, but, somehow, I doubt that's the case when the cameras aren't rolling.

A few years ago I went to the annual porn convention here in NYC. The boys from Flava were there as was Pitbull Productions and Tyson Cane. This was the first time I had ever been close to these people and I left feeling sorry for them. Not only are these men poorly educated but many of them have criminal records that more or less keep them in a position that they have to do what they can to survive on a day to day basis. Very few of them are getting more that $500 per pic. What does that tell you. You can go down in the village and catch a few of the one pic only stars sitting in the bars peddling their services for $150 at best. To make porn nowadays the only thing required is a camera and 2 people who are willing to be filmed. It is sad that young man died but I think out of fairness more should be written about his life and what led him to porn. Like it or not he was a damn good porn star and did not give the impression that he was only there for the money.

While it is unfortunate that the VP of Flava Works has passed, the struggle to encourage black gay men (and the black community) to protect ourselves from the deadly disease known as HIV/AIDS continues. As I see it, it's now or never. There should never be a moratorium when it comes to discussing a deadly sexually-transmitted disease that puts our community at continuous risk. This time is more perfect than any other.


Furthermore, Flava Works needs to leave Jasmyne and other Black gay and lesbians alone. If Phil Bleicher's "company" wasn't so unscrupulous perhaps the media and those in the black gay blogosphere wouldn't have to write about his exploitive company.


Additionally, I have no sympathy for people - whether they are dead or alive - who exploit young people - particularly black gay men (or women) - for profit.

I daresay this issue is unlikely to reach a satisfactory resolution anytime soon. I think BOTH sides in this ongoing saga have something to answer for in their conduct. Bleicher & Co. are shady, there seems little doubt about that. Yet those who made the media aware of the activities in the FlavaWorks house are also a bit underhanded in their tactics. In reporting the dispute, Keith highlights an interesting quandary, too: There will always be a demand for porn. In meeting that demand, how should film companies (like FlavaWorks) manage their affairs?

More than anything, we as LGBT bloggers and people who are concerned about "our people" should be held more accountable. It has been pointed out that many of the porn models whether they are with FlavaWorks or another porn company are "at-risk youths, runaways, homeless, and easy targets" for porn companies to make money. AND then some are not! But my challenge to myself and other bloggers would be to create a program, give guidance, take an initiative to do more for these at-risk youths. Many of younger people (more now than years ago) come out to their family at an early age and their family abandon them leaving them to fight for their own.

If we all took a little less time writing about allegations and spent a little more time trying to find solutions and ways to help these younger gay men and women to a better life and give them more resources (maybe a Big brother Big Sister Program) we would not have to talk so much about or worry so much about Porn companies and their operations bec

It really would be nice to see these people with these blogs try reaching out just a little further to the youth at risk with suggestions as to how to better themselves than just preach about exploitation. There are currently 60 job professions that an ex-felon can not hold. I have never been arrested before but there are plenty of kids who hang out on the pier in NYC that have been and still don't understand fully the consequences of what they did and how they are going to pay for it. I went to a community college in inner city Baltimore to learn spanish because it is obvious that nowadays you are going to have to know two languages to get anywhere in the job market. Black Americans are slowly being replaced with Dominicans here in NYC. It is time to start waking up our young gay brothers and sisters.

The Black community has a large problem in my opinion: it tries to "save" too many people because once upon a time we were very similar and our struggle was universal. These conditions, realities and opportunities have changed and that is not true any longer. The Black community tends to see a hole in the boat and start to panic. They rush to one side of the boat causing more water to spill inside due to the weight change. We tend to stand there too long examining a problem that is not really one to begin and we drown in despair without direction or hope. We become jaded that there is nothing we can do; sometimes the best thing to do is nothing. Not realizing if you go about what you are doing and periodically mop up the water that comes in when a wave crests all will be alright. It will take care of itself because you can not control the ocean of life on which everyone has been cast upon.

Is it not true that the suit is about posting copyrights images of some of the recent models next to headlines claiming they had AIDS? I know several of the guys and they were very hurt by those posts.

It seems that this issue has strayed far from the original 2005 issues and become a personal issue. I hope that all involved will regain focus on keeping people healthy and aware instead of chasing the homophobic and racist reports of a local NBC reporter.

There are companies all over this country that specialize in videos depicting men of all races practicing unsafe sex with great abandon. I really don't see why so much attention is being paid to a company who has not allowed any non condom penetrative sex in any of their videos since 2005.

No other company is as restrictive about safe sex issues or as supportive of their models then Flava seems to be. What reason could there be for for the constant attacks by bloggers and conservative local news?

Some of you make many valid points, and while I find the "actors" to be quite vulgar and pathetic since they are risking their lives for a few coins, but, its their choice. As is mine not to feel sorry for them when they die at a young age since they chose to play with their lives for whatever reason in 2007. Its all about choice, and, you can't put your morals onto anyone, gay or straight. No to be insensitive to the death of Devin, who I knew as a wonderful person, but life must go on. We cannot stop the attacks on a social injustice just because of a persons death. People die everyday, we would never get anything done. I do believe that to single out Phillip Bleicher is unfair but someone has to be the example. The industry should be held accountable but not more than the pornstars themselves. We as a race need to take into accountability out own actions. What has made us get to the point where this would be an option? What are we missing from our lives?
